Summary: Under the auspices of “Terminating the Green New Deal,” the EO pauses the disbursement of funds appropriated through the Inflation Reduction Act of 2022 or the Infrastructure Investment and Jobs Act including but not limited to funds for electric vehicle charging stations. It is unclear whether the EO will pause funding of loans that have previously closed, as funds provided to loan recipients may come from separate authorities not necessarily implicated in the EO (as opposed to the credit subsidy costs that come from the cited authorities in the EO). OMB guidance narrows the scope of this pause to only funds supporting the “Green New Deal” — funds that are not implicated or contradicted by the policies outlined in the EO will not necessarily be subject to a pause, depending on how agencies exercise discretion in implementing the EO. The EO also mandates review of all processes, policies, and programs for issuing grants, loans, contracts, and other disbursements that are inconsistent with listed policies. In addition, the EO directs that when procuring goods and services, making leases or other disbursements of Federal funds that agencies prioritize cost-effectiveness, American workers and businesses, and sensible use of taxpayer money.
